World of Warcraft “Race to Level 50” Contest Terms
Article 1: The Company Vivendi Universal Games International S.A., which head office is located in Velizy Villacoublay (78143), Blizzard Europe Entertainment TSA 60 001 and operating under the commercial name of Blizzard is organizing a competition on the following website: www.wow-europe.com, from the 7th of March, 2006, 09:01 Central European Time (“CET”) to the 28th of March, 2006, 08:59 CET (included).
Article 2: The competition is opened to anyone aged 15 or more residing in France, in Belgium, in the United Kingdom or in Luxemburg, or anyone aged 18 or more residing in Germany, Austria, Sweden, Finland, Denmark, Norway, or in Ireland, having subscribed to the World of Warcraft game and having an active registered account to World of Warcraft, except Blizzard personnel and their family, affiliates or business partners.
Article 3: Entrants automatically accept the terms of this competition and acknowledge the fact that this game being French, the competition is governed by French law.
Article 4: Failure to observe the terms stated here will lead to the nullification of the participation.
Article 5: Entrants are required to have a valid, registered World of Warcraft Account as of 21:01 CET on Monday, March 6 2006 to be eligible to participate in the Contest. Only 1 (one) participation per Account will be accepted.
Article 6: Aim of the Competition: The contest will take place on “World of Warcraft” internet servers that will be designated as “public test realms” specifically for the Contest by Blizzard (the “Designated Test Realms”). To participate in the Contest, a qualified entrant must create a World of Warcraft character on one of these designated servers, and be one of the first 1,000 qualified entrants to level a character to level 50 during the Contest Period. In the event that 1,000 qualified entrants are not able to level a character on the Designated Test Realms to level 50 during the Contest Period, then the 1,000 qualified entrants who either level their characters to level 50, or are closest to reaching level 50 will be adjudged to be the Grand Prize Winners. All game play must adhere to the World of Warcraft Terms of Use, and any violation thereof will invalidate your entry in the Contest. Additionally, false or deceptive entries or acts, as well as acts of cheating, will render the entrant ineligible.
Article 7: Determination of Winners. The one thousand qualified entrants who are the first to level a character to level 50 on the Designated Test Realms during the Contest Period will be chosen as Grand Prize Winners.
Article 8: Grand Prizes: One thousand (1,000) qualified entrants (“Grand Prize Winners”) shall win a place to participate in a “beta test” of an upcoming Blizzard Entertainment interactive product (no retail value), subject to the Grand Prize Winner agreeing to the terms of a Beta Test Agreement to receive the Grand Prize. It is expected that the Beta Test to take place prior to December 31, 2006.
Article 9: Blizzard, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Blizzard ; or (d) any printing or typographical errors in any materials associated with the Contest. Additionally, the Contest will take place on the “public test realms,” and it is anticipated that each of the Designated Test Realms (as defined below) may not be available for certain ‘extended’ periods of time on a daily basis during the Contest.
Article 10: The winners will be notified within 10 working days. The prize will be sent to winners via e-mail at the address they give in the form.
Article 11: Resale of the prize is forbidden. No exchange of the prize worth against money, another prize, object or service different from a prize eventually won by an entrant will be accepted. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
Article 12: The details of each entrant (name and e-mail address) will be transmitted by the Blizzard server, which will process the data. The data will be collected during the online subscription of each user on the www.wow-europe.com website according to the « Informatique et Libertés » law, of the 6th of January 1978 and its later amendments, and according to the European directive number 95/46/CE.
Each entrant grants Vivendi Universal Games International permission to use the information he is providing within the framework set by the« Informatique et Libertés » law of the 6th of January 1978. Each entrant benefits from the right to access and modify his personal data.
Article 13: In case of litigation, only tribunals in the country of physical residence of the head office of the organizing company will have jurisdiction.
Article 14: Responsibility.
In case of circumstances outside Vivendi Universal Games International’s control, in a fortuitous case, or under exceptional circumstances (fire, flood, natural disaster, malevolent intrusion in the IT system, strike, jeopardize of the financial and technical viability of the competition etc.), even in the case of its own responsibility (subject to its good faith), Vivendi Universal Games International retains the right to cancel the whole or part of the competition. The present competition will be cancelled in case circumstances outside Vivendi Universal Games International’s control, without the entrants or winners being able to claim any form of compensation. Vivendi Universal Games International retains the right to exclude entry to the present competition any individual having cheated, deceived, faked or disturbed the operations stated in this terms. Vivendi Universal Games International retains the right to sue any individual having cheated, deceived, faked or disturbed the operations stated in this terms, or tried to do so. A winner having disturbed the competition in any of the ways described in the present terms will be rightfully denied the right to claim any prize. Any addition or amendment to these terms will be announced on the Internet. They will be considered appendices to the present terms.
